Some of the BNT guys know about this already and all of the nkft, but for the rest of you hard core bass fisherman I need to fill you in on what’s going on with me and are friends at the DFG and The county of San Luis Obispo. Last year in Nov. we held a terny @ Lake Nacimiento, at that time a game warden decided to stop me in the middle of are terny so he could see the permit. Well he had to stop one person that had to stop another person to stop me, but anyhow for some reason I could not find the permit, I don’t know if I miss placed it or just left it at home. I tried to call the house to see if my girlfriend could fax a copy but she was unreachable. So I asked the warden if I needed to stop the terny and he said no….So he went to some of the guys that were fishing in that area and asked them how they were doing and what are they fishing for, they said good and we are fishing for bass, both the fisherman had there limits. At that point the warden stopped the fisherman, and asked to look at the fish. After seeing that that had 5 fish he said they cannot fish anymore. Do to the fact that they have 5 fish and if that caught one more to call, they would have 6 fish in position. I don’t understand we are just a small club trying to stay out of trouble, But you can see big advents on the TV calling 5 fish in Ca, Any way I got a couple of phone call from the warden after the tern, asking if I could fax the permit, I told him that I had misplaced it but I know you guys have a copy of it a the dfg. Yes I’m guilty of not having the permit on hand, I understand that, what happens next I think to my self, I recieved a letter in the mail stating so,


Dear Mr. Owen
Application has been made to this office to file a criminal complaint against you by the California Dept. Fish & Game.

After careful review of the reports presented, this office has decided to charge you with violations of:

Section 230(F) of the California Code Of Regulation Title 14, a misdemeanor
(a total of 1 count)

You should appear at 549 10th Street, Paso Robles, California 93446 at 8:00am on March 18, 2004.
Failure to appear may result in the court issuing a warrant for your arrest.

Very truly yours, so fore…..

Ps what the hell does Section 230(F) of the California Code Of Regulation Title 14, a misdemeanor(a total of 1 count) mean. Oya if anyone is going to be around San Luis Obispo that day I could use the support. Remember I just do this for thr fun of it.

Under 230(f) you are charged with not having each person in the Tournament have in their possession a copy of the Special Conditions of your permit. Did you have a exemption for 12" fish, 5 fish bag where the regular bag is less, a special rule that DFG imposed or anything like that? If so, every contestant needs to have a copy of the permit so the warden knows they are in the tournament.

You can go to http://www.dfg.ca.gov and look around for the Title 14 CCR regs (maybe somewhere else, I'm not sure) for Section 230(f) for specific wording.

Most wardens are fairly lax on tournament rules, but evidently you did something (s)he felt was worthy of a citation.

Good luck in court. Be sure to take a copy of your permit.

First off, I have never entered a bass tourney BUT, you truely did pay right? Since you did, you should have a receipt or something to prove the fact of. What ever paper document you can provide will be helpful. Hopefully you can find the original permit! But, if you provide no paper document. Then, sorry my friend, you are screwed! Your word does not mean skwat in a court of law. I wish you the best. Please report your out come.

The only permit that every participants other than the terny director has to possess is an Angling Regulation Exemption Request Form. This is for Event Permits only. It states all tournament participants are to have a copy of the permit and exemption in their possession when fishing an exempt tournament. Lake Nacimiento does not need a exemption permit because the lake already has a 5 fish limit @ 12to 15 in. per fish.

I under stand what you are saying, But I think the fact of the matter is not that I did not have the permit it’s the fact that I did not have the permit in possession. I called the region and they said they have a copy of the permit.

very simple. If you don't show up; they issue a warrant for your arrest. SOOOOOOOOOOOOO....show up WITH the original permit issued. Consider it being caught driving without your license in "possesion". And have a good attitude because its all up to the judge at that point.

And "YES", when you have a full limit on board, you can NOT have another fish in your possesion. Its been reported here that trouters at castaic were getting warned about continuing to fish when they have a full limit on their stringer.

The rules are there for everyone.

If you read the whole story wils you would understand buuuuuuuuuuuut you did not, the morel of the story is not guilty or not guilty.... it’s the fact of the matter why can one of the biggest bass fishing club in the world can get away with calling 5 fish on national TV.

Dude, if they have a copy make SURE you get a copy of the copy BEFORE the court date. You must have some EVIDENCE in order to relieve yourself. Good fortune.

I don't believe in LUCK. Luck belongs to those whom can not provide good fortune for themselves.

That DFG warden is a complete ####! You know what, #### happens. Big deal, you forgot the permit. Fight it and you'll win. A-hole wardens like this give a bad name to all other DFG wardens.

yes I read your whole pooooooooooooooooost.

IIIIIIIIIFFFFFFFFFFFFFF you want to get into a discussion about tournaments and limits and fish and game regulations, then start one with the appropriate title.
I got a lot to say about THAAAAAAAAAAAAAAAAT.

This one was entitled: "DFG & MEEEEEEEEEEEEEEEEE".

In the letter it states something about the safe welfare of the fish, IF IT WAS NOT FOR ARE STRONG CATCH AND RELEASE PROGRAMES THERE WOULD NOT BE THE GREAT FISHING THERE IS TODAY, THEY DON’T SAVE THE FISH, WE DO. Hay thanks for all the input, its people like you guys that make Cal, Fishing such a great place to pull info from.:-)
